Any booking deposit received denotes acceptance of these our Terms and Conditions of business.
In these conditions. The Venue means The Venue Urmston (t/a Urmston Masonic Hall Ltd) Temple Suite means The Temple Suite at The Venue Urmston (t/a Urmston Masonic Hall Ltd) t/a UMH Ltd means Trading as Urmston Masonic Hall Ltd Client means The person, firm or company who accepts the quotation from The Venue Urmston for the booking of The Venue Urmston or Temple Suite or any part thereof or whose booking for The Venue Urmston or Temple Suite is accepted by The Venue Urmston (t/a UMH Ltd) Services means the services or goods which The Venue Urmston (t/a UMH Ltd) is to supply in accordance with these conditions.Function means the event in The Venue Urmston or Temple Suite for which UMH Ltd is to supply services in Accordance with these Conditions. Conditions means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed via email between The Venue Urmston (t/a UMH Ltd and the client) Number means Number of persons attending the Function.
Any reference in these Conditions to any provisions of a statute shall be construed with any email as amended and reacted on extended at the relevant time.
The headings in these Conditions are for convenience only and shall not affect their interpretation.
2.BASIS OF THE SALE
The Venue Urmston (t/a UMH Ltd) shall sell and the client shall purchase the Services in accordance with any emailed quotation of The Venue Urmston (t/a UMH Ltd) which is accepted by the Client or any emailed order or deposit payment of the Client which is accepted by The Venue Urmston (t/a UMH Ltd), subject in either case to the Conditions which will now govern the Contract of the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted or any such order is made or purported to be made by the Client.
No variation to these Conditions shall be binding unless agreed by email between the client and the authorised representatives of The Venue Urmston (t/a UMH Ltd).
The Venue (t/a UMH Ltd) employees or agents are not authorised to make any representations concerning the services unless confirmed by The Venue Urmston (t/a UMH Ltd) by email.
In entering into the contract the Client acknowledges that it does not rely on and waives any claim for breach of any such representations which are not so confirmed.
Any typographical, clerical or other error or omission in any sales literature quotation price list acceptance of offer invoice or other documents or information issued by The Venue Urmston (t/a UMH Ltd) shall be subject to correction without any liability on the part of The Venue (t/a UMH Ltd).
3.BOOKING OF THE VENUE URMSTON and THE TEMPLE
No order submitted by the Client shall be deemed to be accepted by The Venue Urmston (t/a UMH Ltd) unless and until confirmed via email to The Venue Urmston (t/a UMH Ltd) and a non re-fundable or transferable booking fee from £150.00 and a security deposit of £250.00 paid and accepted. A Provisional Booking will only be held for 48 Hours. The security deposit will be refundable 7 days after the function if no damage has occurred. Please note that your email confirmation acts as your confirmation/contract with us and does not require a reply or signature
Fees for the hire of The Venue Urmston or The Temple for Civil Wedding Ceremonies are variable & subject to type of booking & Number of guests.
The Client shall be responsible for notifying The Venue Urmston (t/a UMH Ltd) not less than seven days prior to the date of the function the number of persons who will be attending the event and of the catering required. The price of service will be calculated on such final numbers or on the numbers actually attending the function whichever is the greater.
If a contract is accepted by The Venue Urmston (t/a UMH Ltd) on the basis that a minimum/maximum number of persons will be attending the Function the price of the Services will be calculated on such a minimum number of persons or on the number of persons actually attending the Function whichever is the greater. If more numbers attend than are declared The Venue Urmston (t/a UMH Ltd) reserve the right to close down the Function on the grounds of safety or charge for extra numbers.
A Client shall be entitled to cancel a Contract by giving not less than 90 days notice by email prior to the date of the Function. Any deposits paid up to that time are not refundable. If less than 90 days notice by email is given and The Venue Urmston (t/a UMH Ltd) is unable to replace the Contract then the Client will be liable for any loss suffered by The Venue Urmston (t/a UMH Ltd)/suppliers as a result of such a cancellation. In the event you have also secured any of our third party suppliers ie DJ/room dressing, the full fee will be payable unless 6 months cancellation is received via email.
The Venue Urmston (t/a UMH Ltd) reserve the right to cancel a Function any time by giving not less than 30 days notice via email prior to the date of the Function. Any deposits paid up to that time will be fully refundable. This applies to room hire only and not deposits paid to secure suppliers.
The standard times at which Evening only Function are to begin and end shall be 6.00pm until 1200 midnight. Music can be played by the DJ until 11.45pm. No variation in such times shall be possible unless confirmed via email by The Venue Urmston Management. (t/a UMH Ltd). Please note that setup and access times can only be agreed 48 hours before your event. Extra charges may apply subject to such times.
The sale of non-alcoholic / alcoholic drinks will cease at 12.00 midnight No variation in such times shall be possible unless confirmed via email by The Venue Urmston (t/a UMH Ltd).
The doors giving access to the Garden area shall remain closed from 9.30 pm in accordance with the Noise Regulations issued by Trafford Council Environment Unit and must be strictly adhered to. Please note that we charge £50 if you bring your own entertainment/DJ/music. If you have sub-contracted any third party suppliers The Venue Urmston (t/a UMH Ltd) accepts no liability whatsoever for any claims against them.
Once a booking has been made we will issue an email confirmation, this requires no reply or any signature. If a credit/debit card has been given, we reserve the right without notice to deduct any cancellation fee and/or any losses or damages too property, fixtures, fittings and hired items.
We clearly state on our confirmation email everything that we have agreed for your event. Any extra charges ie: use of our kitchen in any capacity or items such as our food heater, sound system, projection unit and anything else not listed in the email, this includes removal of any waste/use of our bins on room hire only bookings are all chargeable.
The Client shall observe the provisions of the Licensing Act 2003 (as amended).
The Client and his/her guests shall not bring any intoxicating liquor into the Function without prior emailed consent of The Venue Urmston (t/a UMH Ltd). Any own drinks found on possible random bag inspection will be confiscated. Any drinks found to be consumed or discarded on or at the end of ANY EVENTS and the £250 security card fee that we may hold for any potential damages or losses the said deposit may also used to compensate our bar revenue losses at full retail bar price of the item found or possible closure of the event.
The Function shall not be used to hold cinematograph exhibitions, boxing, wrestling or any stage play for which a statutory license is required unless such a license has been granted and with the prior emailed approval of The Venue Urmston (t/a UMH Ltd) and in that eventually the Client shall strictly obey and observe all the requirements laid down in the licence.
5.PRICE OF SERVICES
The price of Service shall be The Venue Urmston (t/a UMH Ltd) currently quoted price list or emailed quotation. However, where no price has been quoted by email (or a quoted price is no longer valid) the price list in The Venue Urmston (t/a UMH Ltd) published price list current at the date of the Function is applicable. All prices are valid for 30 days only or until earlier acceptance by the Client after which time they may be altered by The Venue Urmston (t/a UMH Ltd) without giving notice to the Client.
The Venue Urmston (t/a UMH Ltd) reserve the right to give notice to the Client at any time before the holding of the Function to increase the price of Services to reflect any increase in the cost to The Venue Urmston (ha UMH Ltd) which is due to any factor beyond the control of The Venue (t/a UMH Ltd).
6.TERMS OF PAYMENT
Save herein after mentioned the Client shall pay the balance of the invoice for the Services at least thirty days prior to the date of the Function.
Receipts for payment will be issued only upon request via email from our bookings manager.
Any invoice issued shall be paid within ten days of the date of the function UMH Ltd reserve the right to invoice the Client for the price of services at any time before the date of the function, and if the Client fail to make payment not less than thirty days prior to the date of the function then UMH Ltd shall be entitled to cancel the function.
The time of payment of the price of services shall be of the essence of the contract. Without prejudice to any other rights of UMH Ltd deposits are non refundable.
If the Client fails to pay the total email price by the due date UMH Ltd reserve the right to cancel the function or the Client shalt pay interest on any overdue amount from the date on which payment was due to that on which it is made (whether before or after agreement) on a daily basis at the rate of 4% per annum above the base rate from the time to time quoted by Barclay's Bank plc and reimburse to UMH Ltd all costs and expenses (including legal costs) incurred in the collection of any overdue amount via a small claims court.
No alteration or addition to or interference with The Venue Urmston's (t/a UMH Ltd's) electrical system shall be permitted.
No externally-sourced DJ's equipment will be allowed to interfere with the normal electrical supply. All electrical equipment brought on to The Venue Urmston (t/a UMH Ltd) premises shall have a current Certificate of PORTABLE APPLIANCE TEST. (Current PAT testing Certificate).
Normal electrical supply is available from the general purpose ring main 13amp sockets outlets. If the client requires any additional supplies then he /she shall give to The Venue Urmston (t/a UMH Ltd) not less than one weeks emailed notice prior to the date of the Function of his/her requirements and pay The Venue Urmston (t/a UMH Ltd) any additional fee thereafter.
There is an audio sound sensor/restrictor in place within The Venue Urmston (t/a UMH Ltd) as required by Trafford Environment Dept set at 93 decibels which will automatically switch the power OFF if exceeded. The Venue Urmston (t/a UMH Ltd) will not be liable for any damage caused to DJ Equipment should these levels be exceeded. Any interference with the Audio sound sensor/restrictor system will result in the forfeit of the £250.00 Security Deposit.
The Venue Urmston (t/a UMH Ltd) shall have the liability to the Client (other than liability for death or personal injury resulting from negligence) for any loss or damage of any nature arising from any breach of any expression implied warranty or condition of the Contract or any negligence breach of statutory or other duty on the part of The Venue Urmston (t/a UMH Ltd) its employees or agents or in any other way out of or in connection with the performance of purported performance of or failure to perform the Contract except in accordance with this condition.
The Client shall be responsible for any loss or damage expense or other liability caused to The Venue Urmston (tla UMH Ltd) by the Client's guests or employees and shall pay to The Venue Urmston (t/a UMH Ltd) forthwith on demand the amount required to remedy or make good any such loss or damage expense or other liability.
The contract between The Venue Urmston (ha UMH Ltd) and the Client as principals and shall not be assignable in whole or part by the Client without the express email consent of The Venue Urmston (t/a UMH Ltd).
The Venue Urmston (t/a UMH Ltd) reserves to itself its officials and employees and all other authorised by it right to enter at all times the part or parts of The Venue Urmston and The Temple in which the Function to be held.
Any other notice given under these Conditions shall be via email to the receiving party at its principal place of business or such other address as may at the relevant time have been notified to the party giving notice and shall be deemed to have been given on the date of the email.
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby.
When any dressing package is booked please note that you are responsible for all hired items. In the event of any loss or damages we have the right to deduct any new for old replacement cost from your agreed payment method without notice.
Once a deposit has been paid and a supplier's services are booked please note that any deposit is non-refundable unnder any circumstances and that if your event is cancelled within 6 months of the event date full cancellation fee is payable.
9.GENERAL & FURTHER EXPLANATIONS
Any complaint must be lodged with The Venue Urmston (t/a UMH Ltd) representative at the time of occurrence and by email to The Venue Urmston (t/a UMH Ltd) within seven days of the Function. NO complaint will be accepted any later.
No food whatsoever must be brought into The Venue Urmston (t/a UMH Ltd) for consumption on the premises (other than Wedding, Christening or Birthday cakes) without expressed permission of The Venue Urmston (t/a UMH Ltd) management. Where agreement/charge has been made with The Venue Urmston (t/a UMH Ltd) the hirer is fully responsible for food hygiene and a current Food Hygiene Certificate must be provided. Please also be aware of any food alergies. If we have agreed kitchen use, the kitchen must be left full cleaned and any losses or damages are fully payable on a new for old basis.
No spirits, wines or any other intoxicants must be brought onto The Venue Urmston (t/a UMH Ltd) premises at any time for consumption thereon (However Raffle Prizes (Alcoholic) are permitted but must NOT be consumed on the premises).
All menus must be confirmed at least 30 days before the Function. The final numbers to be catered must be confirmed 30 days prior to the Function (this is the numbers that will be charged regardless of a lower number attending) together with a table plan or seating arrangements. Any food allergies must be highlighted via email to The Venue Urmston (t/a UMH Ltd) and we accept no liability.
The Client will be responsible at all times for keeping good order and well running of the Function. There will be NO FIREWORKS, CANDLES or NAKED FLAMES allowed at any time on the Premises or Function Rooms, under both the Trafford Health and Safety Regulations and Manchester County Fire Regulations. The Venue Urmston (t/a UMH Ltd) reserve the right to close down the function if this regulation is not adhered to.
Parents/Guardians with children must keep them supervised at all times while on The Venue Urmston (t/aUMH Ltd) premises.
Persons using the car park do so at their own risk The Venue Urmston (t/a UMH Ltd) and their agents accept no responsibility for any vehicle or their contents. Please note that vehicles may be left overnight however you will need to speak to the room manager of the event regarding access times the following day.
The stated number of persons attending a function cannot be increased once the final numbers have been declared, without reference to the Management/Caterer.
Bar staff are engaged on the basis of numbers declared. The Venue Urmston (t/a UMH Ltd) reserve the right to close down the function if more than declared numbers attend the function.
The Venue Urmston (t/a UMH Ltd) will not be held responsible for any of its Patrons or their Guests in the Violation of any Health & Safety regulations.
Please note any violation of articles 7.4 and 9.2 / 9.3 / 9.5 and 10 of this contract will lead to the forfeit of the £250.00 Security Deposit.
Should your event be affected by the current Coronavirus outbreak and is cancelled by you or officially by the UK Government, any deposits or balance payments made are not refundable but may be transferred to a future available date.
